The victim told police he was exiting Earl's Place, 23rd Street and Snyder Avenue, at about 1:15 a.m. when two men turned the corner, came up behind him and suddenly opened fire.

The victim could provide police with no further descriptions of the men other than he did not know them and they were in dark clothing, but investigators did recover ballistics evidence at the scene.

Gun charges filed

Seventeen people, including two local men, were charged Monday with the illegal transfer or theft of handguns by the Gun Violence Task Force, a joint effort of District Attorney Lynne Abraham, Attorney General Tom Corbett and Police Commissioner Charles H. Ramsey.

The District Attorney's Office identified the two locals as Kevin Miller, 47, from the 2200 block of South Cross Street, and Anthony Formisano, 34, from the 2300 block of South 10th Street.

A convicted felon, Miller allegedly falsified forms in an attempt to obtain a license to carry a firearm, according to court records. He is charged with a former convicted felon in possession of a firearm; tampering with public records or information; and unsworn falsification.

Formisano is accused of selling three handguns on the street, including a .38-caliber revolver, a 9mm and a .380 for $200 each, according to court records. All three firearms were recovered by police. Formisano was charged with illegal transfer of firearms and conspiracy.

Since it began in December 2006, the task force has launched 1,164 investigations involving the illegal transfer of firearms, executed 365 arrests and taken 704 firearms off the street.
